Lois Riess held without Bail in Fort Myers

Extradition complete, alleged killer-granny Lois Riess has arrived in Lee County, and at first appearance today, the judge determined she will be held without bail. Riess is currently facing second degree murder charges in the death of Pamela Hutchinson, who’s body was found a couple weeks ago on Fort Myers Beach. Riess allegedly killed her, stole her identity, her vehicle and cash, and used them to flee to Texas, where she was caught last week. Riess is also suspected in the death of her husband in Minnesota, though charges are still pending there.  LCSO even had her delivered to the main office so they could give her a perp walk: a rare ‘honor’ not seen since they picked up Mark Sievers.

While the current charges are for second degree murder, the State could take the case to a grand jury to indict for first degree murder, as the murder appears to be premeditated. If the charges are upped to first degree, the state could decide to seek the death penalty, in light of the aggravating factors that Mrs. Riess may have committed the offense for pecuniary gain and to aid her flight from the earlier murder she may have committed. There may be mitigating factors, such as mental health issues: Texas has indicated that she suffers dementia. Insanity could be a defense, if the mental health disorders were so severe she could not tell right from wrong, though the fact that she may have plotted a murder to abscond on a previous murder would vitiate her insanity claim. The case will be interesting from a legal standpoint.

Bill Cosby: Guilty, Guilty, Guilty

Bill Cosby was found guilty of all three counts of aggravated indecent assault in a Pennsylvania courtroom this afternoon. The charges stem from accusations that he drugged and sexually assaulted a woman at his home. He faces up to 10 years in prison on each count. After the verdict, the prosecutor asked that his bond be revoked pending sentencing, and Cosby audibly called him an “Asshole” in court. The judge declined, leaving the same bond in place. Sentencing will probably not be for a few weeks, and Cosby will need to undergo an assessment to see if he must register as a violent sexual predator. He will certainly appeal, and will probably try to secure a bond while the appeal is ongoing, as well.

This brings to close a saga that began with the accusation 13 years ago. The prosecutor at the time initially did not prosecute, and Cosby claimed that he had an immunity agreement in place before he testified at the deposition in the related civil suit: which he ended up settling for $3.4 million dollars. Later, after publicity, a new prosecutor was elected who then filed on criminal charges, and no immunity agreement was ever produced, so the court allowed him to proceed and to introduce the deposition testimony by Cosby. The first trial ended in a mistrial. This trial included additional evidence, included testimony from five other women that claim Cosby drugged them and took advantage of them, and also from a woman who claimed that the accuser told her that she was going to make up an accusation to try to cash in. His new attorney, Tom Meserau, tried a different, more aggressive approach with the accuser. The jurors must not have been persuaded as they found him guilty as charged.

Not only does it firmly bring down the comedian formerly referred to as America’s Dad, it makes the ‘special sauce’ episode of the Cosby Show really creepy in hindsight… Also, when you get found guilty of sexual assault, it’s not the prosecutor who is an ‘asshole’.

Lois Riess, who is accused of killing a woman who looked like her in Fort Myers as she fled from charges of murdering her husband in Minnesota, was arrested a few days ago in Texas. Minnesota authorities have indicated that they will wait for Florida to prosecute her while they are still building their murder case against her. There is a warrant for murder charges out of Lee County, while Minnesota initially only filed theft related charges, but it is expected that murder charges will be filed when the investigation is complete. It remains to be seen if Lee County will seek to indict on first degree murder charges, or leave it at second degree. She will face life in prison either way, but the State could seek the death penalty if they up it to first degree murder.

Bill Cosby’s Second Trial Going to Jury

Closing arguments are scheduled today in Bill Cosby’s second trial on charges of drugging and sexually abusing a woman, Andrew Costand. The case previously went to trial last year, and ended in a hung jury. This time around, there was some additional evidence that went in front of the jury. The prosecutors were permitted to introduce the testimony of several other women, including supermodel Janice Dickinson, who allege that Cosby also drugged and assaulted them in a similar manner: in the first trial, they were only permitted to introduce the testimony of one women, who did not testify in this case. That’s huge for the effect on the impression of Cosby’s character. However, the Defense was permitted to introduce the testimony of a co-worker of the accuser, who claims that Constand had confided that she had a plan to accuse Cosby in order to cash in, and that she ultimately received a settlement of $3.4 million. That evidence was not heard at the first trial, either.

Closing arguments should conclude today, though jury deliberations may continue beyond this evening. The tenor of this trial was very different, as Cosby’s new attorney Tom Mesereau pointedly attacked the accuser and her financial interest in the claims. They also introduced evidence from Cosby’s private plane suggesting he was not even in Philadelphia at the time she alleges the attack to have occurred. The case will soon be in the hands of the jury- Cosby faces several years in prison for the three counts, of he could walk free. This is the only case of the multiple accusations against him for which the statute of limitations has not expired. The last jury deliberated over the course of six days, so it may be a while before there is a verdict.

Lois Riess, who was arrested in Texas and facing murder charges in Fort Myers and her native Minnesota, had an extradition hearing today. She waived her right to fight extradition to either state: so whoever comes to get her first can bring her back. It is expected that Florida will collect her first: Lee County filed murder charges while the murder case from Minnesota was still under review, and she could potentially be facing first degree murder charges for the tourist she allegedly shot to steal hear identity on Fort Myers Beach.

Apparently, some authorities are calling her “Losing Streak Lois”, due to her gambling losses at casinos… but she might have been apprehended to quickly for that to stick. This silver fox was not sly enough to avoid capture. The Star Tribune has good details of the alert restaurant employees that spotted her and helped authorities capture her in Texas. Likely, the prosecutors in Lee County and in Minnesota will talk and decide who will prosecute her first, and it would not surprise me if she ends up headed to SW Florida.

Lois Riess, a possible serial killer who struck on Fort Myers Beach, has been captured. Authorities caught her in Texas on South Padre Island: a resort location about 45 minutes from the Mexican border. She faces charges for killing a tourist that resembled her on Fort Myers Beach, to assume her identity as she was hiding out for the murder of her husband in Minnesota. It remains to be seen if she will be transported to deal with her charges in Florida or Minnesota first. Her Lee County, FL case could potentially be a death penalty case, as it sounds like an intentional, pre-planned first degree murder, done with the intent to hide out from her earlier crimes. She was apparently captured when an alert restaurant employee recognized her and called authorities. She apparently missed the news that hiding out usually means laying low…

Friday Fun! Florida Man Films his own Crime, and Gives the Video to the Police

Xavier Moran, a 25-year old from Royal Palm Beach, was involved in an accident and told deputies that he had been cut off by another vehicle and that he could prove it. He provided deputies with a dash camera that had been recording in his vehicle. However, when deputies looked back at the tape, they found something more interesting. Moran had taped footage of himself burglarizing a beauty store! The recorded video showed him take a bat out of the trunk and a man using the bat to bust out the store windows. Deputies charged him with burglary.

Moran is also facing charges for aggravated assault, resisting and escape, but its unclear if those are related to the crash (they are unrelated to the burglary.) Cops love it when criminals solve cases for them…

Friday Fun: Florida Woman Blames Wind for Cocaine in her Car

A Fort Pierce woman had a unique excuse for the cocaine officers found in her car last week. Officers found Marijuana and Cocaine in the vehicle Kenneshia Posey was riding in with another person. When they asked her, she admitted the marijuana was hers, but denied knowing anything about the baggie of cocaine. When the officer asked how it got in her purse, she replied, “I don’t know anything about any cocaine. It’s a windy day. It must have flown through the window and into my purse.”

Officers were apparently unimpressed, as she was arrested and charged for both the marijuana and the cocaine.

A manhunt is underway for the woman suspected in a murder at Fort Myers Beach that was discovered on Tuesday. Detectives believe Lois Riess was hiding out in the Fort Myers Beach area, and targeted victim Pamela Hutchinson due to the similarity of their appearance. Ms. Hutchinson was found deceased in her hotel room, murdered by a gunshot to the head. LCSO believes Riess then stole Ms. Hutchinson’s identity, and her car, and her current whereabouts are unknown: though they indicate she may have fled to Texas.

Ms. Riess was already the suspect in the murder of her husband in Minnesota. David Riess was found dead after he failed to show up for a fishing trip on March 23. His body was found in their home with multiple gunshot wounds, his car was missing, and money had been taken out of his business account and transferred to his personal account. Authorities allege Riess then forged his signature on checks which she cashed, totaling $11,000. She apparently made her way to Fort Myers Beach, identified Ms. Hutchinson due to her similarity of appearance, and then killed her and fled in her stolen vehicle. A nationwide search is underway, and Ms. Riess is believed to be armed and very dangerous.

FWC looking into Shark Fishing by 2015 Super Bowl MVP Von Miller

Denver Broncos linebacker Von Miller caught a hammerhead shark while fishing in Florida, and posted pictures on social media. Miller is well known, not only for being Super Bowl MVP, but he has also done a lot of commercials and even appeared on Dancing with the Stars. Now he’s in hot water as there may be an investigation since hammerheads are a protected species. The video, embedded in the TMZ article, shows that the shark was released alive, but it also shows the shark was bleeding on the boat, and distressed when returned to the water.

 

I don’t think Miller is in the wrong here, as he has video showing the shark’s release. FWC will still conduct an investigation, but it won’t need to be too intensive. It appears he is on a fishing charter. It’s incumbent on the captain to ensure that the animals are treated humanely by everyone on board, and returned safely. Miller could be facing misdemeanor criminal charges. I don’t see any charges for Viller, and hopefully, the shark was ok.
