LCSO May have been Using Illegal Radar Guns for 10 Years

WINK News found that the Lee County Sheriff’s Office purchased one or more batches of Python II radar detectors starting in 2004. The problem is, the Python II is not approved for use in the State of Florida. The beam projected by the radar Python II is 15 degrees, 25% wider than the 12 degree beam permissible by Florida regulations. Since it is not on the approved list, it should not be admissible in court. Sadly, who knows how many of the 50,000 speeding tickets issued by LCSO were not properly issued.

It is illegal in Florida to possess an Alligator. Charles Edwards, aka “Half-Breed”, a Collier County resident, was caught with a dozen baby gators being held in an aquarium under his apartment, in a storage area. Investigators think he may have been trying to sell them. He is still sitting in jail, as he has not been able to post bond. Possession of an alligator is a felony charge in Florida. The State of Florida has chosen to give heightened protection to gators, even though their numbers have rebounded, and are no longer endangered. Regardless of your opinion of the policy, gators are protected under Florida law.

Sexual Predator is about the worst thing you can be called under the law. The Florida DHSMV erroneously put a sexual predator designation on the license of Tammy LeMasters, from Orlando. The good news is, it is an easy fix (after she gets through the line at the DHSMV. The bad news is mostly embarrassment. She is planning a lawsuit, though it is hard to claim much actual damage. The notoriety of the lawsuit will far exceed any reputational harm she had for the few people who saw the erroneous license!

J. Patrick Buckley III was arrested yesterday for Grand Theft and Fraud charges. The charges likely relate to the trust account issue that led to Buckley’s suspension by the Florida bar a few months ago, initially in January, 2015. There isn’t much available yet on the details of the charge, so I am speculating that they are connected. However, the charges are consistent to the Bar allegations that he misappropriated client funds.

Prosecutors Won’t Seek 15-Year PRR Max Sentence for Sex on the Beach

couple that were convicted this week for having sex on the beach in Bradenton. Because he was released from prison within 3 years of the offense, he was facing Prison Releasee Reoffender sentence, which would have mandated the maximum 15 years, to be serve day for day (no time off for good behavior).

Apparently, Brodsky has relented, after the case brought the attention of Families Against Minimum Mandatory sentences (FAMM). As we pointed out on Crimcourts: it costs about $18,000 per year to incarcerate someone… an his full sentence could have cost taxpayers $270,000. He’s still going to be looking at some time, but thanks to some magnanimity from the prosecutor, not a full 15. The judge would not have had discretion, had the state proceeded with the PRR sentence.
